FCRA is central law administered by the Ministry of Home Affairs. Uttar Pradesh does not issue FCRA registration or prior permission. This state page exists only to help UP-based societies, trusts and Section 8 companies prepare entity records, governance evidence and banking paperwork for filings on fcraonline.nic.in.

For eligibility, routes and national process detail, prefer the national FCRA guide. This page concentrates on UP operational context that still blocks or delays MHA filings when entity papers are inconsistent.

Draft for human regulatory review.

National MHA jurisdiction (unchanged in UP)

Registration / prior permission / renewal / annual return / designated FCRA account / change intimations follow the FCRA Act & Rules and MHA notifications. Use FCRA Online as the filing surface. Confirm live form labels (commonly discussed as FC-3A / FC-3B / FC-4 pathways in national advisory materials) on official channels before relying on any summary.

Entity registration ≠ FCRA permission

  • Entity layer (UP / company law): society registration, trust deed or Section 8 incorporation—and ongoing maintenance of registered-office details, governing documents and office-bearer records recognised for that entity type in Uttar Pradesh.
  • FCRA layer (national): MHA decision on registration or prior permission to receive foreign contribution, plus ongoing returns and intimations. A clean UP entity registration is necessary operational groundwork; it is not FCRA approval.

UP operational readiness that still matters

  1. Registered-office consistency: address proofs, letterheads and portal entries should match the organisation’s current UP registered office / principal place records.
  2. Governance pack: board/office-bearer list with ID and address proofs; board resolution(s) authorising FCRA action; bye-laws/deed aligned to FCRA-permitted purposes.
  3. Track-record evidence: activity reports and audited financials as expected for the chosen national route (registration vs prior permission)—confirm current MHA expectations.
  4. Designated banking architecture: foreign contribution receipt only in the designated FCRA account framework notified for SBI New Delhi Main Branch; plan compliant utilisation-account arrangements as directed nationally. UP location does not create a different bank rule.
  5. Reporting workflow: diary FC-4 annual return and intimations of changes after permission is granted; national materials commonly treat FC-4 as due by 31 December for the previous FY—verify live MHA instructions.

Common preparation issues for UP-based organisations

  • Mixing domestic and foreign-contribution banking narratives before a designated account exists
  • Objects or programmes poorly aligned to FCRA-permitted purposes
  • Office-bearer KYC or registered-office proofs that do not match UP entity records
  • Assuming a district NGO practice or “state NOC” replaces MHA permission
  • Late renewal or incomplete annual-return evidence after registration

District practices differ; the legal standard does not. Prefer mha.gov.in and FCRA Online over consultancy blogs.

Frequently Asked Questions

Does Uttar Pradesh have its own FCRA rules?

No. FCRA is central. UP context matters for entity registration records and operational documentation, not for a separate foreign-contribution code.

If my society is registered in UP, am I FCRA-approved?

No. UP (or company-law) entity registration is separate from MHA FCRA registration or prior permission.

Do UP organisations still need the SBI designated FCRA account?

Yes, under the current national designated-account directions notified by MHA—location of the NGO in UP does not create a different bank rule. Confirm the live MHA instruction.

When should I use the national FCRA page instead of this UP page?

Use the national guide for eligibility, route choice and process detail. Use this UP page when your registered office/operations are in Uttar Pradesh and you need entity-document and banking-readiness framing.
